31-Year-Old Newark Man Sentenced To State Prison For The 2017 Kidnapping, Rape, & Robbery Of A Kearny Woman

KEARNY, NJ.- Hudson County Prosecutor Esther Suarez reported on Wednesday, July 24, 2024, that Evin Ferman-Argueta, 31, of Newark, New Jersey, appeared in Hudson County Superior Court and was sentenced by Superior Court Judge John A. Young for his role in a 2017 Home Invasion in Kearny, New Jersey.

     According to court documents, Ferman-Argueta previously entered into a plea agreement with the Hudson County Prosecutors Office and pleaded guilty to the charges of Kidnapping; Robbery; and Aggravated Sexual Assault.

     On Wednesday, in accordance with the plea agreement, Judge Young sentenced Ferman-Argueta to 25 years in New Jersey State Prison. The 25-year sentence for Kidnapping will run concurrently with 18-year sentences for the charges of Aggravated Sexual Assault. 

     Judge Young ordered that the sentences be subject to the No Early Release Act, which will require Ferman-Argueta to serve 85% of his custodial term before becoming eligible for parole. Upon his release from prison, Ferman-Argueta will be required to register as a sex offender under Megan’s Law and will be on parole supervision for life.

     The guilty pleas and sentence stem from an investigation that began on December 22, 2017, when, at around 7:30 a.m., the Kearny Police Department received a 911 Emergency Call reporting a burglary at a residence in the center of the town of Kearny. 

     Upon arrival, Police Officers encountered a female victim who reported that multiple unknown men entered her apartment. The men demanded money and sexually assaulted her before leaving with her car and numerous personal items from the home.

     Ferman-Argueta’s two codefendants, Erick Leon-Farinago, 27, of Belleville, New Jersey, and David Gualteros, 28, of Newark, New Jersey, have both pleaded guilty to kidnapping and are awaiting sentencing.
