JERSEY CITY, NJ.- Hudson County Prosecutor Esther Suarez reported that, following an investigation on Tuesday, October 2, 2024, Detectives of the Hudson County Prosecutor’s Office Special Victims Unit arrested an 18-year-old Jersey City man for allegedly placing a recording device in a public bathroom at the Newport Mall in Jersey City.

Andy Cardenas, 18, of Jersey City, was taken into custody at the Hudson County Prosecutor’s Office in Secaucus, New Jersey, and was formally charged with one count of third-degree Invasion of Privacy. Cardenas was processed on the charge and released on a complaint summons pending his first appearance in Hudson County Central Judicial Processing Court, which has been tentatively scheduled for Tuesday, October 22, 2024.

The charge stems from an investigation that began on Friday, August 9, 2024, when a woman discovered a black device in the family bathroom on the first floor of the JC Penny department store at the Newport Mall.

The Hudson County Special Victims Unit was contacted and launched an investigation. During the investigation, Detectives identified Cardenas as a person of interest. During further investigation, multiple digital files were recovered from the recording device. Detectives have yet to determine how long the device was placed in the family bathroom or other restrooms at different locations.

The investigation remains active and ongoing. Anyone with additional information regarding this incident is urged to contact the Hudson County Prosecutor’s Office Special Victims Unit at (201) 915-1234. All calls will be kept confidential.

“The rules of the court require us to include a statement that states: The charges outlined in this publication are merely accusations, and the defendant and or defendants are presumed innocent unless and until proven guilty beyond reasonable doubt.”
