CLARKSBURG, W.VA.- On Tuesday, November 5, 2024, a Federal Grand Jury for the Northern District of West Virginia returned an indictment against James Mansfield Davis, 67, of Morgantown, West Virginia, charging Davis with one count of Failing to Surrender for a Federal Prison Sentence.
According to charging information unsealed in the indictment, Davis was previously sentenced to a term of 82 months in federal prison for a child pornography charge in the Northern District of West Virginia. Davis was ordered to report to begin serving his sentence on October 4, 2024. Davis failed to surrender himself to the Bureau of Prisons and was later arrested on October 15, 2024, in Williamsburg, Virginia, by members of the U.S. Marshals Service.
According to Assistant U.S. Attorney Christie Utt, who presented the case before the Grand Jury, if convicted at trial, Davis faces up to ten years in federal prison. The actual term of imprisonment will be determined by a U.S. District Court Judge based on the seriousness of the offense and Davis’ prior criminal history.
