Nicholas County Man Pleads Guilty To Gun Crime

CHARLESTON, W.VA.- On Thursday, November 14, 2024, Nathaniel Martin, 50, of Fenwick, West Virginia, appeared in U.S. District Court for the Southern District of West Virginia and pleaded guilty before U.S. District Court Judge Irene C. Berger to one count of Being a Prohibited Person in Possession of a Firearm.
According to U.S. Attorney Will Thompson and charging information with the court, on September 6, 2021, Martin possessed a Smith & Wesson Model M&P Shield .40-caliber handgun while in Nicholas County, West Virginia.
Federal law prohibits a person with a prior felony conviction from owning or possessing a firearm or ammunition. Martin knew he was a prohibited person due to his previous felony conviction for two counts of Delivery of a Scheduled II Controlled Substance in Nicholas County Circuit Court in June 2009.
Following entering his guilty plea on Thursday, Judge Berger accepted the plea and scheduled sentencing for March 13, 2025. At that time, Martin faces up to 10 years in federal prison, up to three years of supervised release, and a $250,000 fine.
U.S. Attorney Thompson commended the investigative work of the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the United States Forest Service for Martin’s arrest and Thursday’s guilty plea.
