Troy Man Pleads Guilty To Possessing Machinegun While Selling Illicit Drugs

ALBANY, NY.- On Monday, December 9, 2024, Richawn McClain, 26, of Troy, New York, appeared in the U.S. District Court for the Northern District of New York and pleaded guilty before a U.S. District Court Judge to Possession with Intent to Distribute Fentanyl; and Possession with Intent to Distribute Cocaine; and Possession of a Firearm in Furtherance of a Drug Trafficking Crime.

     When sentenced, McClain faces a mandatory minimum of 10 years and up to life in federal prison, at least three years and up to life of supervised release, and a $1 million fine. The actual term of imprisonment will be determined by a U.S. District Court Judge based on the seriousness of the offenses and McClain’s prior criminal history, if any.

     According to U.S. Attorney Carla B. Freedman, During Monday’s plea allocution, McClain admitted that on January 9, 2024, he possessed a handgun that had been modified to make it a fully automatic machinegun. McClain further admitted that he possessed 32 grams of cocaine and more than 900 counterfeit fentanyl-laced pills, all inside a bag that contained the firearm. McClain also had $22,770 in U.S. currency in his possession, and as part of the plea agreement, McClain will forfeit the money.

     U.S. Attorney Freedman commended the investigative work of the U.S. Drug Enforcement Administration, leading to McClain’s guilty plea on Monday.
