Kanawha County Man Pleads Guilty To Throwing Away U.S. Mail

CHARLESTON, W.VA.- On Wednesday, January 8, 2025, Brice Allen Pomeroy, 26, of Hernshaw, West Virginia, appeared in the U.S. District Court for the Southern District of West Virginia and pleaded guilty before U. S. District Court Judge Irene C. Berger to one count of Obstruction of Mail.

     According to U.S. Attorney Will Thompson and charging documents filed in the District Court on May 11, 2023, Pomeroy knowingly and willfully threw away around 227 pieces of U.S. Mail by taking a large plastic bag containing mail addressed to others by dumping it into a trash can located outside a gas station in Charleston, West Virginia.

     At the time, Pomeroy was employed by a United States Postal Service vendor as a mail handler at the vendor’s facility in Charleston, West Virginia.

     After entering his guilty plea on Wednesday, Judge Berger accepted the plea and scheduled sentencing for April 24, 2025, at which time Pomeroy faces up to six months in federal prison, up to one year of supervised release, and a $5,000 fine. At sentencing, Judge Berger will also order Pomeroy to pay $2,051.21 in restitution.
