Huntington Man Sentenced For Selling Fentanyl While On Supervised Release

HUNTINGTON, W.VA.- Today, January 27, 2025, Tyson Davis, Sr., 45, of Huntington, West Virginia, appeared in the U.S. District Court for the Southern District of West Virginia and was sentenced by U.S. District Court Judge Robert C. Chambers to 86 months in federal prison, to be followed by three years of supervised release for his guilty pleas to Distribution of Fentanyl; and Violation of Federal Supervised Release.

     According to U.S. Attorney Will Thompson and charging documents filed with the District Court, on June 14, 2023, Davis sold around 2.93 grams of fentanyl to a confidential informant while in a parked vehicle in Huntington, West Virginia, during a controlled buy under the observation of law enforcement investigators.

Davis Admitted To Selling The Fentanyl

     During his plea allocution, Davis admitted to the fentanyl sale. During the investigation, investigators conducted three additional controlled buys with Davis using the confidential informant on June 8th, August 3rd, and October 24, 2023. During all four controlled buys, Davis sold a total of 24,057 grams of substances containing fentanyl to the confidential informant.

     According to laboratory analysis of the narcotics sold by Davis revealed, on June 8th and June 14th, the substances contained at least 58 percent pure fentanyl, and the substance sold on August 3rd was at least 46 percent pure fentanyl. According to law enforcement investigators, the fentanyl they seize typically contains between 0.5 percent and 7 percent pure fentanyl.

     Davis has a lengthy criminal history that includes multiple convictions for drug and firearms offenses. At the time of the instant offense, Davis was serving a term of supervised release for his May 17, 2021, conviction for possession of a firearm in furtherance of a drug trafficking crime. Judge Chambers’ sentence today includes 30 months for violating the terms of his supervised release.
