Trenton Man Found Guilty Of Aggravated Assault & Weapons Charges

TRENTON, NJ.- A 26-year-old Trenton, New Jersey, man is facing spending up to the next three decades in New Jersey State Prison after being convicted earlier this week by a Mercer County jury in connection with a shooting incident that occurred in August 2022 in the City of Trenton.

     According to Mercer County Prosecutor Janetta D. Marbrey, on Wednesday, February 5, 2025, a jury sitting in Mercer County, New Jersey, found Davion S. Smith, 26, of Trenton, guilty on all counts of the indictment on the charges of Aggravated Assault; Unlawful Possession of a Weapon; Possession of a Weapon for an Unlawful Purpose; and Certain Persons Not to Possess Weapons.

Smith Found Guilty And Faces Up To 30 Years In Prison

     The Jury returned the verdict following a two-week trial before Mercer County Superior Court Judge Darlene J. Pereksta. Following the jury returning the findings of guilt, Judge Pereksta accepted the verdict and scheduled sentencing for April 4, 2025. At that time, Smith faces up to 30 years in State Prison due to the jury finding him eligible for an extended term under New Jersey’s Persistent Offender sentencing guidelines.

     The conviction stems from an incident that unfolded on August 13, 2022, when, at around 1:30 a.m., members of the Trenton Police Department responded to a report of gunfire on the 100 Block of Oakland Avenue in the City of Trenton.

     As Police Officers were arriving on the scene, they observed a vehicle driven by Smith leaving the scene at a high rate of speed. Police Officers were able to stop the vehicle, and a subsequent search uncovered a defaced .38-caliber revolver with an obliterated serial number. During the investigation, Detectives recovered surveillance video that captured Smith firing the revolver in the direction of a separate vehicle before fleeing the scene.
