Honduran National Charged Failing To Depart & Hindering Removal

HARRISBURG, PA.- A 26-year-old Honduran national who thought he was above the law is now facing eight years in federal prison for failing to leave the United States even after a federal immigration judge gave him a three-month grace period to return to Honduras.

     On Wednesday, February 19, 2025, a Federal Grand Jury for the Middle District of Pennsylvania returned a two-count Indictment charging Noel Chinchilla-Avilez, 26, of Honduras, with Failure to Depart the United States After a Final Removal Order; and Hindering Removal.

Indictment Alleges Chinchilla-Avilez Failed To Leave

     According to Acting U.S. Attorney John C. Gurganus and charging information unsealed in the indictment. It is alleged that Chinchilla-Avilez, following appearing in a U.S. Immigration Court, was ordered to depart from the United States within 90 days. It is further alleged that after 90 days, Chinchilla-Avilez failed to leave as required by the order, and further hindered his removal from the United States.

     If convicted at trial, Chinchilla-Avilez faces up to 8 years in federal prison, at least one year of supervised release, and a $500,000 fine. Upon completion of any sentence imposed, Chinchilla-Avilez would face immediate deportation back to Honduras and would be barred from returning to the U.S6. Upon finding guilt, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offense and Chinchilla-Avilez’s prior criminal history.

     Acting U.S. Attorney commended the investigative work of the agents of U.S. Homeland Security Investigations for the apprehension of Chinchilla-Alilez and the investigation leading to the indictment.
