Honduran Illegal Migrant Charged With Illegally Reentering The U.S.

HARRISBURG, PA.- On Tuesday, April 8, 2025, a Federal Grand Jury for the Middle District of Pennsylvania returned an indictment charging Misael Garcia-Diaz, 34, of Honduras, illegally residing in the Middle District of Pennsylvania, with one count of Illegal Reentry into the United States by a Previously Deported Alien.
If convicted, Garcia-Diaz faces up to 10 years in federal prison, at least one year of supervised release, and a $250,000 fine. At sentencing upon a finding of guilt, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offense and Garcia-Diaz’s prior criminal history. Following any term of imprisonment, Garcia-Diaz will face immediate deportation proceedings and be removed from the country.

According to Acting U.S. Attorney John C. Gurganus and charing information unsealed in the indictment, it is alleged that Garcia-Diaz was previously removed from the United States on April 22, 2014, through Brownsville, Texas. The indictment further alleges that Garcia-Diaz was subsequently found in the United States without obtaining permission or legal authorization to enter the United States. The indictment also alleges that on February 6, 2025, Garcia-Diaz was encountered illegally in Tioga County, Pennsylvania.
Acting U.S. Attorney Gurganus commended the investigative work of U.S. Immigration and Customs Enforcement’s Enforcement Removal Operations for the investigation that led to Garcia-Diaz’s indictment.
