ASBURY PARK, NJ.- A 19-year-old Asbury Park, New Jersey, man found out that he would most likely be a senior citizen when he is released from prison after a Monmouth Couty Superior Court Judge sentenced him last Tuesday to over four decades in New Jersey State Prison for fatally gunning down a 19-year-old man on an Asbury Park street, during the summer months of 2022.
According to Monmouth County Prosecutor Raymond S. Santiago, on Tuesday, April 22, 2025, Joseph N. Argilagos, 19, of Asbury Park, appeared in Monmouth County Superior Court and was sentenced by Superior Court Judge Jill Grace O’Malley to 45 years in New Jersey State Prison for his December 18, 2024 conviction on murder and a weapons-related offense charges for the July 8, 2022, shooting death of Daniel Vernet, 19, of Asbury Park, New Jersey.
Judge O’Malley Orders Sentence To Be Subject To No Early Release Act
In handing down the sentence on Tuesday, Judge O’Malley ordered Argilagos to serve 45 years for the Murder charge, subject to the No Early Release Act, which will require him to serve 85% of his custodial term before becoming eligible for parole. In addition, Judge O’Malley sentenced Argilagos to a seven-year prison term for the Weapons charge, with a mandatory 42 months of parole ineligibility, pursuant to the Graves Act, to run concurrently with the 45-year sentence.
Argilagos’ co-defendant, Lydell Brown, pleaded guilty to Conspiracy to Commit Murder after a Monmouth County jury failed to reach a verdict on the charges that were filed against him. Brown was sentenced on March 12, 2025, to five years in New Jersey State Prison subject to the No Early Release Act.
Argilagos, who was initially charged as a juvenile, was waived up to adult court in September of 2023 upon a motion by the Monmouth County Prosecutor’s Office shortly before a Monmouth County Grand Jury indicted both he and Brown as accomplices in the shooting death of Mr. Vernet.
During the trial before Judge O’Malley, the jury heard evidence establishing that shortly after 5:45 p.m. on Friday, July 8, 2022, members of the Asbury Police Department responded to a report of gunfire on the 100 Block of Prospect Avenue, near the intersection of Atlantic Avenue.
Upon arrival, Police Officers encountered Mr. Vernet, suffering from multiple gunshot wounds. He was transported to Jersey Shore University Medical Center, where, despite life-saving efforts by doctors, he succumbed to his wounds and was pronounced deceased around an hour later.
