CONCORD, NH.- A 29-year-old Guatemalan national, illegally residing in Massachusetts, is facing up to five years in federal prison after pleading guilty on Tuesday to harboring an unlawful alien who illegally crossed the United States-Canadian border in September 2024.

According to Acting U.S. Attorney Jay McCormack, on Tuesday, April 29, 2025, Esdras Aaron Calel-Cumes, 29, of Guatemala, illegally residing in the District of Massachusetts, appeared in the U.S District Court for the District of New Hampshire and pleaded guilty before U.S. District Court Judge Joseph N. Laplante to Bringing in and Harboring Certain Aliens.

Calel-Cumes Faces Up To Five Years In Federal Prison

Following entering his guilty plea on Tuesday, Judge Laplante accepted the plea and scheduled sentencing for August 11, 2025. At that time, Calel-Cumes faces up to 5 years in federal prison, at least three years of supervised release, and a $250,000 fine. At sentencing, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offense and Calel-Cumes’ prior criminal history.

Upon the completion of any sentence imposed, Calel-Cumes will face immediate deportation proceedings, be removed from the United States, and be returned to Guatemala.

According to charging documents filed with the district court, on September 9, 2024, U.S. Customs and Border Protection detected a male, subsequently identified as Luis Felipe Xiloj-Ambrocio, crossing illegally from Canada into the United States in Pittsburg, New Hampshire. Calel-Cumes traveled from Massachusetts to pick up Xiloj-Ambrocio. At the time of their apprehension by Customs and Border Patrol agents, Calel-Cumes and Xiloj-Ambrocio were driving South on Route 3 in New Hampshire.

Neither Xiloj-Ambrocio nor Calel-Cumes had legal immigration status to be present in the United States. Xiloj-Ambrocio previously pleaded guilty in Federal Court in Concord, New Hampshire, to one count of illegal entry and has since been deported.
