BOSTON, MA.- On Thursday, May 1, 2025, Axel Aguasvivas-Martinez, 31, a Dominican national illegally residing in Dorchester, Massachusetts, appeared in the U.S. District Court for the District of Massachusetts and pleaded guilty before U.S. District Court Judge Allison Burroughs to an indictment charging him with one count of Illegal Reentry into the United States by a Previously Deported Alien.

Following entering his guilty plea, Judge Burroughs accepted the plea and scheduled sentencing for June 3, 2025. At that time, Aguasvivas-Martinez faces up to 24 months in federal prison, one year of supervised release, and a $250,000 fine. At sentencing, a U.S. District Court will determine the term of imprisonment based on the seriousness of the offense and Aguasvivas-Martinez’s prior criminal history.

Upon completion of any sentence imposed, Aguasvivas-Martinez will face immediate deportation proceedings and be removed from the country.

According To Charging Documents

According to U.S. Attorney Leah B. Foley and charging information filed with the District Court, in March 2024, Aguasvivas-Martinez was charged by federal criminal complaint with unlawful reentry into the United States by deported alien. On April 17, 2025, a Federal Grand Jury returned an indictment on the charge.

The offense occurred on or about November 23, 2021, when Aguasvivas-Martinez was found illegally in the District of Massachusetts without receiving permission or legal authorization after he was previously removed from the United States to the Dominican Republic on January 5, 2016.
