 Salina Convicted Child Predator Charged With Child Pornography

SYRACUSE, NY.- A 69-year-old Salina, New York, man, who is a previously convicted child prison, is once again potentially facing the possibility of spending the rest of his life in federal prison after being indicted last week on a federal child pornography offense.

     Last week, a Federal Grand Jury for the Middle District of New York returned an indictment, charging Kenneth Martin, 69, of Salina, New York, with Possession of Child Pornography. Martin was taken into custody and made his initial appearance in Federal Court in Syracuse, New York, and was arraigned on the charge.

According To The U.S. Attorney’s Office

     According to U.S. Attorney John Sarcone, III, and charging information unsealed in the indictment, it is alleged that Martin knowingly possessed an electronic device containing numerous digital images and video files depicting the graphic sexual exploitation and abuse of children, some including prepubescent children being sexually abused by adults.

     The conduct in the instant charge follows Martin’s 2020 conviction in Onondaga County Superior Court for Possessing a Sexual Performance by a child.

     If convicted at trial, Martin faces a mandatory minimum of ten years and up to 20 years in federal prison, at least five years and up to a lifetime of supervised release, and a $250,000 fine. At sentencing upon a finding of guilt, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offense and Martin’s prior criminal history.

     U.S. Attorney Sarcone commended the investigative work of the Federal Bureau of Investigation, the New York State Police, and the Onondaga County Sheriff’s Office for the investigation that led to Martin’s indictment.

“The rules of the federal court require us to include a statement that states: The charges outlined in this publication are merely accusations, and the defendant and or defendants are presumed innocent unless and until proven guilty beyond reasonable doubt.”
