BALTIMORE, MD.- Last Friday, a 36-year-old Baltimore, Maryland, man found out he will be spending over six years in federal prison after being sentenced for being a convicted felon in possession of a firearm and ammunition.

On Friday, May 9, 2025, Derek Harvey, 36, of Baltimore, Maryland, appeared in the U.S. District Court for the District of Maryland and was sentenced by U.S. District Court Judge Matthew J. Maddox to 78 months in federal prison, to be followed by three years of supervised release after pleading guilty to being a Prohibited Person in Possession of a Firearm and Ammunition.

According To The U.S. Attorney’s Office

According to U.S. Attorney Kelly O. Hayes and charging documents filed with the district court, on January 26, 2024, while observing a Citi Watch Camera, a Baltimore City Police Department Detective observed a hand-to-hand gun exchange on Milton Avenue. The Detective saw Harvey and his co-defendant, Robert Jackson, walking southbound on North Milton Avenue in the City of Baltimore.

While walking, Jackson reached into his hoodie and pulled out a tan handgun, and handed it to Harvey, who then placed the gun in his waistband. Baltimore Police Department Detectives arrested both men shortly after observing the weapon exchange, seizing the handgun and ammunition.

Federal law prohibits a person with a prior felony conviction from owning or possessing a firearm and ammunition. Harvey knew when he possessed the handgun due to prior felony convictions.
