Mexican National Sentenced For Narcotics Distribution With Children

MCALLEN, TX.- Last Tuesday, a 39-year-old Mexican national illegally residing in McAllen, Texas, learned he would be spending the next three years in federal prison for distributing cocaine with his children in his vehicle.

     According to U.S. Attorney Nicholas J. Ganjei, on Tuesday, May 20, 2025, Heriberto Marin-Herbert, 39, of Mexico, appeared in the U.S. District Court for the Southern District of Texas and was sentenced by Chief U.S. District Court Judge Randy Crane to 36 months in federal prison for his previously entered guilty plea.

Marin-Herbert Pleads Guilty On November 22, 2024

     Marin-Herbert previously appeared on November 22, 2024, and pleaded guilty before Judge Crane to one count of Conspiracy to Distribute a Controlled Substance, Cocaine; and Possession with Intent to Distribute a Controlled Substance, Cocaine. Upon completion of his federal term of imprisonment, Marin-Herbert will face immediate deportation proceedings and be removed from the United States.

     According to the charging documents filed with the district court, on August 14, 2024, during a narcotics investigation, law enforcement investigators were conducting surveillance on Marin-Herbert when they observed him making hand-to-hand narcotics exchanges throughout McAllen, Texas, with his children inside his vehicle.

     Following observing the narcotics transactions, investigators conducted a traffic stop, at which time Marin-Herbert tossed a box containing cocaine into a ditch in an attempt to avoid detection. During a subsequent search of the box, investigators found multiple individually wrapped baggies of cocaine.

     After taking Marin-Herbert into custody, investigators obtained and executed a court-authorized search warrant at his home. During the search, investigators uncovered and seized additional bags of cocaine, drug scales, drug paraphernalia, two firearms, and over $12,000 in U.S. currency.
