According to Acting U.S. Attorney Lisa G. Johnston and charging documents filed in the District Court, on August 21, 2024, U.S. Immigration and Customs Enforcement agents arrested Alfredo-Diaz in Lewisburg, West Virginia. During the arrest procedure, Alfredo-Diaz admitted to federal agents that he was a citizen of Honduras and was in the United States illegally and further admitted that he had been previously deported from the United States.
Alfredo-Diaz was unable to provide documentation or identification to agents that he had permission or legal authorization to be in the country. Agents then ran a fingerprint comparison and learned that he had been removed twice before, each time following a felony conviction.
Alfredo-Diaz was convicted of felony heroin possession on September 25, 2026, and felony cocaine possession on December 2007, both in Denver County, Colorado District Court. Alfredo-Diaz was removed from the United States to Honduras on December 27, 2026. On July 21, 2010, he was found illegally in Canon City, Colorado, and was subsequently deported to Honduras on August 5, 2010.
Alfredo-Diaz never obtained the express consent from the Secretary of the U.S. Department of Homeland Security to reapply for admission to the United States for either of the prior removals, nor did he seek to reenter the United States through other legal means.
