Guatemalan National Pleads Guilty & Is Sentenced For Illegal Reentry

BOSTON, MA.- A 53-year-old Guatemalan national illegally residing in Waltham, Massachusetts, and previously arrested for indecent assault and battery, will remain in federal custody pending deportation proceedings after pleading guilty and being sentenced on Monday for Illegal Reentry into the United States by a Previously Deported Deported Alien.
According to U.S. Attorney Leah B. Foley, on Monday, June 2, 2025, Edgar Enrique Pineda-Ardon, 53, of Guatemala, illegally residing in the Commonwealth of Massachusettes, appeared in the U.S. District Court for the District of Massachusetts and was sentenced by U.S. District Court Judge Nathaniel M. Gorton to 42 days in federal prison, to be followed by one year of supervised release.
During Monday’s hearing in Federal Court in Boston, Massachusetts, Pineda-Ardon pleaded guilty to one count of Unlawful Reentry into the United States by a Previously Deported Alien. Pineda-Ardon will face immediate deportation proceedings upon completion of his federal prison term and be removed from the country.
According To Charging Documents Filed With The Court
According to charging documents filed with the District Court, in 2014, Pineda-Ardon was apprehended near the U.S.-Mexico border. He claimed asylum and was released on bond. While awaiting his asylum hearing, Pineda-Ardon was arrested for indecent assault and battery. The case was ultimately dismissed for lack of prosecution. However, Pineda-Ardon’s claim for asylum was rejected, and he was removed from the United States in November 2019.
   Sometime after his 2019 removal, Pineda-Ardon, on an unknown date and at an unknown location, illegally reentered the United States without permission or legal authorization to do so. Federal authorities became aware of Pineda-Ardon’s illegal presence in the United States after he was arrested twice in Waltham, Massachusetts. He was taken into custody by immigration officials in April 2025.
