Guatemalan National Charged With Illegal Reentry Into The U.S.

CONCORD, NH.- A 42-year-old Guatemalan national illegally in the State of New Hampshire is facing up to 24 months in federal prison after being indicted on a federal criminal charge of unlawfully being in the United States by a deported alien.
According to Acting U.S. Attorney Jay McCormack, on Friday, June 13, 2025, a Federal Grand Jury for the District of New Hampshire returned an indictment, charging Jorge Misael Niz, 42, of Guatemala, illegally residing in Salem, New Hampshire, with one count of Illegal Reentry into the United States by a Deported Alien.
According To Charging Information Unsealed In The Indictment
According to the charging information unsealed in the indictment, it is alleged that Niz, a Guatemalan national, unlawfully residing in Salem, New Hampshire, was previously deported back to Guatemala on March 30, 2025, and was located in Salem on April 27, 2025, without obtaining permission or legal authorization to enter the country.
Niz, who remains in the custody of Federal Immigration and Customs Enforcement, will appear in Federal Court at a later date to be arraigned on the charge.
If convicted at trial, Niz faces up to 24 months in federal prison, at least one year of supervised release, and a $250,000 fine. Upon a finding of guilt, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offense and Niz’s prior criminal history. Upon completion of any sentence imposed, Niz will face immediate deportation proceedings and be removed from the United States.
