Mexican Man Charged With Illegal Reentry Into The U.S.

HARRISBURG, PA.- A 42-year-old Mexican national, if convicted, will face up to two years in federal prison after being formally indicted last Wednesday for being found unlawfully in the United States after having been previously removed from the country.
According to Acting U.S. Attorney John C. Gurganus, on Wednesday, June 18, 2025, a Federal Grand Jury for the Middle District of Pennsylvania returned an indictment charging Fernando Hernandez-Garfias, 42, of Mexico, illegally residing in the Commonwealth of Pennsylvania, with one count of Illegal Reentry into the United States by a Previously Deported Alien.
According The Charging Information Filed In The Indictment
According to the charging information unsealed in the indictment, it is alleged that on or about May 7, 2025, Hernandez-Garfias was found illegally in York County, Pennsylvania, after previously having been removed from the United States on November 23, 2016, through Brownsville, Texas.
It is further alleged that sometime after his 2016 removal, Hernandez-Garfias, on an unknown date and at an unknown location, illegally reentered the United States without obtaining permission or legal authorization to do so.
If convicted at trial, Hernandez-Garfias faces up to 24 months in federal prison, at least one year of supervised release, and a $250,000 fine. Upon completion of any sentence imposed upon a finding of guilt, Hernandez-Garfias will face immediate deportation proceedings and be removed from the United States.
