HARRISBURG, PA.- A 41-year-old Guatemalan national, illegally residing in Lebanon County, Pennsylvania, will be heading back to Guatemala after being sentenced on Monday, to time served after pleading guilty to unlawfully being in the United States after having been previously removed.

According to Acting U.S. Attorney John C. Gurganus, on Monday, June 30, 2025, Erikx Soto-Gomez, 41, of Guatemala, illegally residing in Lebanon County, Pennsylvania, appeared in the U.S. District Court for the Middle District of Pennsylvania and was sentenced by U.S. District Court Judge Julia K. Munley to time served for Illegal Reentry into the United States by a Deported Alien.

Soto-Gomez, who has been in custody since his April 10, 2025, arrest, will face immediate deportation proceedings and will be removed from the United States.

According To Court Documents

According to court documents, Soto-Gomez was indicted by a Federal Grand Jury after being arrested for Driving Under the Influence in Lebanon County, Pennsylvania. Soto-Gomez had previously been removed from the United States pursuant to a 2012 immigration court removal order.

Sometime after his 2012 removal, Soto-Gomez, on an unknown date and at an unknown location, illegally reentered the United States without permission or legal authorization to do so.

Acting U.S. Attorney Gurganus commended the investigative work of the U.S. Immigration and Customs Enforcement and Enforcement Removal Operations, which led to the successful prosecution of Soto-Gomez.
