Brazilian Convicted Felon Charged With Illegal Reentry Into The U.S.

BOSTON, MA.- A 39-year-old Brazilian man, and a previously deported aggravated felon, is facing up to 20 years in federal prison after being criminally charged in a federal indictment after being found illegally present in the Commonwealth of Massachusetts.
According to U.S. Attorney Leah B. Foley, last week, a Federal Grand Jury for the District of Massachusetts returned an indictment charging Joelson Gomes Fonseca, 39, of Brazil, illegally residing in Framingham, Massachusetts, with one count of Illegal Reenty into the United States by a Deported Alien.
According To The Information Unsealed In The Indictment
According to the charging information unsealed in the indictment, Fonseca was deported by Immigration and Customs Enforcement in March of 2008 after being convicted of an aggravated felony. Sometime after his deportation, at an unknown date and an unknown location, Fonseca illegally reentered the United States without obtaining permission or legal authorization to do so. Fonseca was taken into custody after being found unlawfully in Framingham, Massachusetts.
Fonseca Faces Up To 20 Years In Federal Prison
If convicted at trial, Fonseca faces up to 20 years in federal prison, at least three years of supervised release, and a fine of up to $250,000. At sentencing, upon a finding of guilt, a U.S. District Court Judge would determine the term of imprisonment based on the seriousness of the offense and Fonseca’s prior criminal history.
Upon completion of any sentence imposed, Fonseca would face immediate deportation proceedings and be removed from the United States.
