Mexican Man Charged With Illegal Reentry Into The U.S.

HARRISBURG, PA.- A 51-year-old Mexican national illegally residing in the Commonwealth of Pennsylvania, if convicted, will face up to two years in federal prison after being charged with unlawfully being in the United States by a deported alien.
According to Acting U.S. Attorney John C. Gurganus, on Wednesday, August 6, 2025, a Federal Grand Jury for the Middle District of Pennsylvania, returned an indictment charging Juan Valencia-Diaz, 51, of Mexico, illegally residing in York County, Pennsylvania, with one count of Illegal Reentry into the United States by a Deported Alien.

According to the charging information unsealed in the indictment, it is alleged that Valencia-Diaz had been previously removed from the United States in 2017. It is further alleged that after his removal, on an unknown date and at an unknown location, Valencia-Diaz reentered the United States without permission or legal authorization to do so, after being found on July 19, 2025, illegally present in York County, Pennsylvania.
If convicted at trial, Valencia-Diaz faces up to 24 months in federal prison, at least one year of supervised release, and a $250,000 fine. At sentencing, upon a finding of guilt, a U.S. District Court Judge would determine the term of imprisonment based on the seriousness of the offense and Valencia-Diaz’s prior criminal history. Upon completion of any sentence imposed, upon a finding of guilt, Valencia-Diaz will face immediate deportation proceedings and be removed from the United States.
Acting U.S. Attorney Gurganus commended the investigative work of Immigration and Customs Enforcement and Enforcement Removal Operations, which led to Valencia-Diaz’s apprehension and Wednesday’s federal indictment.
