BUFFALO, NY.- A 22-year-old Guatemalan national and a previously deported alien is facing up to ten years in federal prison after being taken into custody last Tuesday and charged with unlawfully reentering the United States.

According to U.S. Attorney Michael DiGiacomo, on Tuesday, August 5, 2025, Edin Julian Hernandez Mejia, 22, of Guatemala, unlawfully found in the State of New York, was taken into custody and charged by federal criminal complaint with one count of Illegal Reentry into the United States by a Deported Alien.

Hernandez Mejia Will Remain Detained Pending Trial

Following being charged, Hernandez Mejia made his initial appearance before U.S. Magistrate Judge H. Kenneth Schroeder, Jr., and was ordered detained pending future court proceedings in Federal Court for the Western District of New York.

According to the charging information filed in the criminal complaint, on August 5, 2025, law enforcement Officers conducted a traffic stop of a vehicle in which Hernandez Mejia was a passenger. During questioning regarding his citizenship and legal status in the United States, Hernandez Mejia confirmed to Officers that he is a citizen and national of Guatemala, and did not have legal status to be in the United States.

A subsequent records check by U.S. Border Patrol officials confirmed that Hernandez Mejia had been removed from the United States on two separate occasions, in February and March 2024. Sometime after his March 2024 removal, on an unknown date and at an unknown location, Hernandez Mejia illegally reentered the United States without obtaining permission or legal authorization to do so.

If convicted at trial, Hernandez Mejia faces up to ten years in federal prison, at least one year of supervised release, and a $250,000 fine. Upon completion of any sentence imposed, upon a finding of guilt, Hernandez Mejia will face immediate deportation proceedings and be removed from the United States.

“The rules of the federal court require us to include a statement that states: The charges outlined in this publication are merely accusations, and the defendant and or defendants are presumed innocent unless and until proven guilty beyond reasonable doubt.”
