Former Rochester Bus Driver Sentenced For Child Pornography Offense

ROCHESTER, NJ.- A 76-year-old Rochester, New York, man, and convicted child sexual predator will be spending the next decade in federal prison, after being sentenced on Tuesday, on a federal child sexual exploitation offense.
According to U.S. Attorney Michael DiGiacomo, on Tuesday, August 12, 2025, Tomas Rosario, 76, of Rochester, New York, appeared in the U.S. District Court for the Western District of New York and was sentenced by U.S. District Court Judge Frank P. Geraci to 120 months in federal prison, to be followed by seven years of supervised release for his conviction of Attempted Receipt of Child Pornography.
According To Court Documents
According to court documents, Rosario, while employed as a school bus driver in Monroe County, New York, on March 11, 2022, without any other adults or children present, transported a 13-year-old girl to school. During the ride, Rosario allowed the child to sit in the front seat and proceeded to engage her in personal and sexually explicit conversation, including asking the girl if she had ever engaged in sexual conduct with her boyfriend.
At the end of the day, Rosario picked the girl up from school and again allowed her to sit in the front seat. Rosario continued to engage in sexually explicit conversation with the young girl and ultimately subjected her to instances of sexual contact. In addition, Rosario gave the girl his phone number, showed her his home, and encouraged the girl to call and visit if she ever wanted to skip school.
Rosario’s actions were recorded on the bus surveillance system. In one instance, Rosario instructed the girl to take sexually explicit photos of herself and send them to him. On the following day, Rosario encountered the girl at a local convenience store and warned her not to tell anyone what he had done the day before. That encounter was captured by the store’s security cameras.
   U.S. Attorney DiGiacomo commended the investigative work of the Rochester Police Department and the Federal Bureau of Investigation, which led to the successful prosecution of Rosario.Â
