Montgomery County Man Pleads Guilty To Federal Child Pornography Charges

ALBANY, NY.- A 30-year-old Amsterdam, New York, man and child predator will potentially be facing spending up to 40 years in federal prison when sentenced later this year, after pleading guilty last Wednesday to distributing and possessing digital images and video files depicting the sexual exploitation and abuse of prepubescent and pubescent children.
According to Acting U.S. Attorney John A. Sarcone, III, on Wednesday, August 13, 2025, Francis T. DiCaprio, 30, of Amsterdam, New York, appeared in the U.S. District Court for the Northern District of New York and pleaded guilty to Distribution of Child Pornography; and Possession of Child Pornography.
After entering his guilty plea, the Court accepted the plea and scheduled sentencing for December 15, 2025. At that time, DiCaprio faces a mandatory minimum of five years and up to 20 years in federal prison for the distribution count and up to 20 years in federal prison for the possession. In addition, DiCaprio will be subject to at least five years, and up to a lifetime of supervised release and a fine of up to $250,000.
At sentencing, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offenses and DiCaprio’s prior criminal history, if any.
According To Court Documents
According to charging documents and statements made during his plea allocution, DiCaprio admitted that beginning in June 2023 and lasting through February 2024, he utilized Instant Messaging applications to receive and distribute digital images and video files depicting child pornography, and further admitted to storing child pornography on his cellular phone.
During the course of sharing and exchanging child pornography with others, he repeatedly, but falsely, told others that he was actively sexually abusing an 8-year-old child he knew.
   Acting U.S.Attorney Sarcone stated, “DiCaprio committed these abhorrent crimes while vividly describing sexual abuse he fantasized about inflicting on a child he knew. I am grateful to the FBI for finding this disgusting and dangerous individual, getting him off the street and away from children, and bringing him to justice.”
