Rep. Brandon Gill Accuses D.C. Judge Of Aiding Jack Smith’s Secret Probe Of Republican Lawmakers, Including Sen. Ted Cruz

WASHINGTON, DC.- Texas Republican Rep. Brandon Gill has introduced formal articles of impeachment against Chief Judge James Boasberg of the U.S. District Court for the District of Columbia, alleging serious judicial misconduct in connection with Special Counsel Jack Smith’s “Arctic Frost” investigation. The resolution charges that Boasberg overstepped his authority by approving covert subpoenas and nondisclosure orders targeting multiple Republican senators and at least one House member.
Documents released by Sen. Chuck Grassley (R-Iowa) reveal that the Arctic Frost probe involved 197 subpoenas and over 430 entities. Among those secretly targeted were Sens. Ted Cruz (TX), Josh Hawley (MO), Rand Paul (KY), Ron Johnson (WI), Tom Cotton (AR), Marsha Blackburn (TN), Rick Scott (FL), Mike Lee (UT), and J.D. Vance (OH). The subpoenas sought private communications and call data, including geolocation details, for dates surrounding January 6, 2021.
Senator Cruz, one of the most outspoken critics, said AT&T was barred from notifying him about the subpoena for at least a year. The gag order, signed personally by Judge Boasberg at Jack Smith’s request, stated there were “reasonable grounds” to believe disclosure would “result in destruction of evidence” or “intimidation of witnesses.” Cruz called the order “an unprecedented attack on the legislative branch.”
Rep. Gill’s impeachment resolution accuses Boasberg of “weaponizing the bench” and violating the Constitution’s Speech and Debate Clause by enabling executive overreach into the legislative branch. “No judge should act as an agent of political prosecution,” Gill said in a statement, calling the Arctic Frost actions “a dark chapter in judicial abuse.”
While impeachment requires only a simple House majority to pass, conviction and removal require a two-thirds vote in the Senate, a threshold rarely met in American history. Nonetheless, Gill’s resolution has sparked momentum among conservative lawmakers who view it as a long-overdue stand against judicial partisanship.
Critics of the move, including some within the GOP, warn that impeaching judges over controversial rulings risks politicizing the judiciary further. Democrats have dismissed the effort as “political theater,” while the Administrative Office of U.S. Courts has declined to comment on Boasberg’s conduct.
For now, Judge Boasberg remains on the bench, but his actions, and their implications for the balance of powers, have placed the federal judiciary squarely in the political spotlight.
