Mexican National Serving State Prison Sentence Faces New Federal Charge

GREAT BARRINGTON, MA.- On Friday, February 6, 2026, U.S. Attorney Leah B. Foley reported that a Mexican national currently serving a state prison sentence for rape has been charged in federal court with illegally reentering the United States after a prior deportation, according to court records.

     Eugenio Isidro Victoriano, 54, a citizen of Mexico, formerly illegally residing in the Great Barrington, Massachusetts, area, is charged with one count of unlawful reentry of a deported alien. At the time of the federal charge, Isidro Victoriano was incarcerated on state convictions for rape, indecent assault and battery on a person over 14 years of age, and larceny under $1,200.

     According to charging documents, Isidro Victoriano was first encountered unlawfully present in the United States in April 2004, when he was arrested by the U.S. Border Patrol near El Paso. He was subsequently removed from the United States and returned to Mexico.

     Federal authorities allege that at some point after his removal, Isidro Victoriano unlawfully reentered the United States without inspection or authorization.

     In February 2021, Isidro Victoriano was arrested in Great Barrington for operating under the influence of alcohol. Court records indicate that fingerprints taken during that arrest matched his prior immigration records. Despite the match, Isidro Victoriano was released from state custody before immigration authorities were able to take enforcement action.

     According to prosecutors, Isidro Victoriano was arrested again in December 2022 by local law enforcement in Great Barrington, this time on charges of rape, indecent assault and battery on a person over 14 years of age, and larceny under $1,200. In November 2025, he pleaded guilty to those charges and was sentenced to four to six years in state prison, with credit for time served. Following his arrest, immigration authorities lodged a detainer to ensure federal custody upon completion of state proceedings.

     Charging documents further state that after his November 2025 conviction, Isidro Victoriano admitted to authorities that he is not a U.S. citizen, that he paid a smuggler to enter the United States, and that he had no legal authorization to be present in the country.

     The federal charge of unlawful reentry of a deported alien carries a maximum penalty of up to two years in prison, one year of supervised release, and a fine of up to $250,000. Upon completion of any sentence imposed, Isidro Victoriano is subject to deportation.

     Sentencing in the case will be determined by a federal district court judge, in accordance with the U.S. Sentencing Guidelines and applicable federal statutes governing criminal penalties.
