Suspect Arrested In South Carolina Following Cape May County Investigation; Faces Potential 25-Years-To-Life Sentence Under New Jersey’s Jessica Lunsford Act

CAPE MAY, NJ.- A South Carolina man has been arrested and charged in connection with the alleged sexual assault of a juvenile in Cape May County following a multi-state investigation led by New Jersey authorities.
Cape May County Prosecutor Jeffrey H. Sutherland and Cape May City Police Chief Dekon Fashaw announced that William H. Nichols, 32, of Florence County, South Carolina, has been charged following an investigation into the alleged sexual assault of a minor in southern New Jersey.
According to law enforcement officials, the investigation began on February 24, 2026, when the Cape May County Prosecutor’s Office Special Victims Unit, working in coordination with the Cape May City Police Department, received a report alleging that a juvenile had been sexually assaulted.
Authorities said detectives immediately launched an investigation to determine the circumstances surrounding the allegation and identify the individual responsible.
Investigators ultimately identified Nichols as the suspect. By the time charges were filed, officials determined Nichols had returned to Florence County, South Carolina, prompting New Jersey authorities to coordinate with law enforcement in that state.
As a result of the investigation, prosecutors approved criminal charges against Nichols on February 27, 2026.
Nichols has been charged with the following offenses:
- First-degree Aggravated Sexual Assault
- Second-degree Endangering the Welfare of a Child
Following the approval of charges, authorities issued a complaint warrant for Nichols’ arrest.
On March 1, 2026, members of the Florence County Sheriff’s Department located Nichols and placed him under arrest in South Carolina.
Authorities confirmed that Nichols is currently being held at the Florence County Correctional Facility while awaiting extradition to New Jersey, where he will face the charges filed in Cape May County Superior Court.
Severe Penalties Under New Jersey Law;
Under New Jersey law, aggravated sexual assault, classified as a first-degree crime, carries some of the most serious criminal penalties available under the state’s criminal code.
Ordinarily, a conviction for a first-degree offense can result in a sentence of 10 to 20 years in New Jersey State Prison.
However, officials stated that the charges in this case fall under the provisions of New Jersey’s Jessica Lunsford Act, legislation designed to impose enhanced penalties for sexual crimes involving minors.
Under the Jessica Lunsford Act:
- Defendants convicted of certain sexual offenses involving minors face mandatory prison sentences ranging from 25 years to life
- Those convicted must serve a minimum of 25 years before becoming eligible for parole
The law was enacted to strengthen protections for children and ensure that individuals convicted of violent sexual offenses involving minors face lengthy incarceration.

Cape May County Prosecutor Jeffrey H. Sutherland said the case reflects the commitment of law enforcement agencies to aggressively investigate and prosecute allegations involving the abuse of minors.
“This case highlights the ongoing dedication of our law enforcement agencies in protecting the most vulnerable members of our community,” Sutherland said. “We take all allegations of child abuse with the utmost seriousness, and we will continue to ensure that those responsible for such heinous acts are held fully accountable under the law.”
Officials noted that the investigation involved close coordination between local and out-of-state law enforcement agencies.
The Cape May County Prosecutor’s Office and the Cape May City Police Department emphasized that protecting children and vulnerable individuals remains a central mission of their agencies, and investigators will continue to rigorously pursue all allegations of abuse in pursuit of justice.

Officials stated that all tips will be reviewed as part of the continuing investigation.
Nichols will remain in custody in South Carolina until extradition proceedings are completed and he is transferred to New Jersey to face the charges filed against him.
