Tonawanda Man Sentenced For Federal Child Pornography Conviction

BUFFALO, NY.- On Tuesday, a 37-year-old Tonawanda, New York, man learned he would be spending the next two and a half decades in federal prison after being sentenced for engaging and enticing teen girls to send him sexually explicit digital images and video files of herself.

     On Tuesday, April 29, 2025, Michael E. Swain, 37, of Tonawanda, New York, appeared in the U.S. District Court for the Northern District of New York and was sentenced by U.S. District Court Judge Lawrence J. Vilardo to 300 months in federal prison, to be followed by a lifetime of supervised release for his conviction of Production of Child Pornography.

Swain Engaged And Enticed Five Minors

     According to U.S. Attorney Michael DiGiacomo and charging documents filed with the District Court, that between October 20, 2021, and November 1, 2021, Swain coerced and enticed five minor victims to engage in sexually explicit conduct for the purpose of producing child pornography.

     Specifically, Swain communicated with a 15-year-old girl who resided in Colorado utilizing Discord, a social media platform. The communications included sexually graphic conversation, during which Swain requested that the teen girl take sexually explicit photos and record videos of herself engaged in sexual acts and send them to him. In addition, Swain engaged in numerous online sexual communications with the teen girl from around 2019 through 2022, during which other sexually explicit digital images and video files were sent from Swain to the child.

     On February 28, 2023, the Federal Bureau of Investigation executed a court-authorized search warrant at Swain’s Tonawanda, New York residence. During the search, investigators seized multiple electronic devices, including a desktop computer tower, a laptop computer, and an external hard drive. During a forensic examination of the seized devices, investigators uncovered numerous digital images and video files depicting the sexual exploitation and sexual abuse of children.

     U.S. Attorney DiGiacomo commended the investigative work of the Federal Bureau of Investigation, the Tonawanda Police Department, and the New York State Police for the investigation, which led to the successful prosecution of Swain.
