Mexican Man Illegally Residing In W.VA. Pleads Guilty & Sentenced

CHARLESTON, W.VA.- A 20-year-old Mexican national, illegally residing in Charleston, West Virginia, is awaiting deportation after pleading guilty and being sentenced on Thursday, to time served for a federal immigration offense.

     According to Acting U.S. Attorney Lisa G. Johnston, on Thursday, July 24, 2024, Maximino Montalvo-Salas, 20, of Mexico, appeared in the U.S. District Court for the Southern District of West Virginia and pleaded guilty before U.S. District Judge Joseph R. Goodwin to Knowingly Possessing a Fraudulent Permanent Resident Card, “Green Card.” Following pleading guilty, Judge Goodwin immediately sentenced Montalvo-Salas to time served, approximately 4 months.

Montalvo-Salas Facing Removal Fro The U.S.

     Montalvo-Salas was transferred to the custody of federal Immigration and Customs Enforcement officials to be removed from the United States back to Mexico, pursuant to an administrative removal order.

     According to the charging documents filed with the District Court, on March 28, 2025, law enforcement Officers encountered Montalvo-Salas in Charleston, West Virginia. Immigration and Customs Enforcement Agents confirmed that Montalvo-Salas is a citizen of Mexico who is illegally present in the United States and used a counterfeit Immigration Form I-551, also known as a Permanent Resident Card or “Green Card,” to illegally obtain employment in the United States.

     Acting U.S. Attorney Johnston commended the investigative work of U.S. Immigration and Customs Enforcement-Enforcement Removal Operations and the U.S. Department of Homeland Security Investigations, which led to the successful apprehension and prosecution of Montalvo-Salas.
