SCRANTON, PA.- A 57-year-old Dominican national, illegally present in the Commonwealth of Pennsylvania, if convicted, will face up to two years in federal prison after being federally indicted for unlawfully being present in the United States by a deported alien.

According to Acting U.S. Attorney John C. Gurganus, on Thursday, July 24, 2025, a Federal Grand Jury for the Middle District of Pennsylvania returned an indictment charging Luis de Jesus Pichardo, 57, of the Dominican Republic, illegally residing in Carbon County, Pennsylvania, with one count of Illegal Reentry into the United States by a Deported Alien.

According To The Charging Information In The Indictment

According to the charging information unsealed in the indictment, it is alleged that Pichardo, a foreign national and a citizen of the Dominican Republic, having been previously removed from the United States in both 1996 and 2000, was found to be illegally present in the United States, on or about July 16, 2025, in Carbon County, Pennsylvania, and did not obtain permission or legal authorization to do so.

If convicted at trial, Pichardo will face up to 24 months in federal prison and a $250,000 fine. At sentencing, upon a finding of guilt, a U.S. District Court Judge would determine the term of imprisonment based on the seriousness of the offense and Pichardo’s prior criminal history. Upon completion of any sentence imposed, Pichardo will be immediately removed from the United States.

“The rules of the court require us to include a statement that states: The charges outlined in this publication are merely accusations, and the defendant and or defendants are presumed innocent unless and until proven guilty beyond reasonable doubt.”
