BOSTON, MA.- A 49-year-old former Seabrook, New Hampshire, Police Officer, if convicted, will be facing up to 20 years in federal prison after being formally indicted on a federal child pornography offense, alleging that he received video files of young children being raped by adults. Giarrusso was initially arrested on Massachusetts State charges.
According to U.S. Attorney Leah B. Foley, last week, a Federal Grand Jury for the District of Massachusetts returned an indictment charging John Giarrusso, 49, with Receipt of Child Pornography. Giarrusso was taken into custody and detained. Giarrusso will be arraigned on the charge in Federal Court in Boston, Massachusetts, at a time and date to be scheduled by the District Court.
According To The Charging Information Filed In The Indictment
According to the charging information unsealed in the indictment, it is alleged that beginning on October 16, 2024, and lasting through October 17, 2024, Giarrusso knowingly received video files depicting the sexual exploitation and abuse of children through the Social Media Instant Messaging application, Kik.
It is further alleged that the video files Giarrusso received depicted children between the ages of five and eleven years old.
If convicted at trial, Giarrusso faces a mandatory minimum of five years, and up to 20 years in federal prison, at least five years, and up to a lifetime of supervised release, and up to a $250,000 fine. At sentencing, upon a finding of guilt, a U.S. District Court Judge would determine the term of imprisonment, based on the seriousness of the offense and Giarrusso’s prior criminal history, if any.
U.S. Attorney Foley commended the investigative work of the U.S. Department of Homeland Security Investigations, the Haverhill Police Department, and the Essex County District Attorney’s Office.

“The rules of the federal court require us to include a statement that states: The charges outlined in this publication are merely accusations, and the defendant and or defendants are presumed innocent unless and until proven guilty beyond reasonable doubt.”
