Brazilian Illegal Immigrant Charged With Illegal Reentry Into The U.S.

BOSTON, MA.- On Friday, a 51-year-old Brazilian national, illegally residing in Massachusetts, if convicted, is facing up to 10 years in federal prison, after being formally indicted by a Grand Jury for being unlawfully in the United States after being deported.
According to U.S. Attorney Leah B. Foley, on Friday, September 19, 2025, a Federal Grand Jury for the District of Massachusetts returned a one-count indictment charging Evaldo Ferreira Pinto, 51, of Brazil, with one count of Illegal Reentry into the United States by a Deported Alien. Pinto, who remains in custody after being arrested by Federal Immigration Officials, will be arraigned in Federal Court in Boston, Massachusetts, at a later date.
According To The Charging Information Filed In The Indictment
According to the charging information unsealed in the indictment, it is alleged that Pinto was found unlawfully in the United States on August 7, 2025, after previously having been removed from the United States on or about May 31, 2019. The indictment further alleges that sometime after his removal, Pinto, at an unknown date and location, illegally reentered the United States without obtaining permission or legal authorization to do so.
If convicted at trial, Pinto faces a maximum sentence of up to 10 years in federal prison, at least three years of supervised release, and a $250,000 fine. At sentencing, upon a finding of guilty, a U.S. District Court Judge would determine the term of imprisonment based on the seriousness of the offense and Pinto’s prior criminal history. Upon completion of any sentence imposed, Pinto will face immediate deportation proceedings and be removed from the United States to Brazil.
