Salvadoran Illegal Immigrant Pleads Guilty To Unlawful Reentry

BOSTON, MA.- Last Friday, a 46-year-old El Salvadoran man, illegally in the United States, learned he will be facing up to ten years in federal prison when he is sentenced later this month, after pleading guilty to illegally reentering the United States by a previously convicted alien.

     According to U.S. Attorney Leah B. Foley, on Friday, September 26, 2025, Emelio Neftaly Pineda, 46, of El Salvador, illegally residing in Lynn, Massachusetts, appeared in the U.S. District Court for the District of Massachusetts and pleaded guilty before Senior U.S. District Court Judge Patti B. Saris to one count of Illegal Reentry into the United State by a Deported Alien Convicted of a Felony.

     Following entering his guilty plea last Friday, Judge Saris accepted the plea and scheduled sentencing for October 30, 2025. At that time, Pineda faces up to 10 years in federal prison, at least three years of supervised release, and a fine of up to $250,000. At sentencing, a U.S. District Court Judge will determine the term of imprisonment based on the seriousness of the offense and Pineda’s prior criminal history. 

     Upon completion of any sentence imposed, Pineda will face immediate deportation proceedings and be removed from the United States.

According To The Charging Information Filed With The Court

     According to the charging information filed with the District Court, Pineda was removed from the United States in July 2016 after having been convicted of a felony. Sometime after being removed, Pineda, at an unknown date and location, reentered the United States without obtaining permission or legal authorization to do so. Pineda was subsequently taken into custody after being found unlawfully in Massachusetts and indicted by a Federal Grand Jury in July 2025.

     U.S. Attorney Foley commended the investigative work of U.S. Immigration and Customs Enforcement, Enforcement Removal Operations, for the apprehension and guilty plea by Pineda.
