Brick Township Man Pleads Guilty To Child Pornography Offense

BRICK TOWNSHIP, NJ.- A 42-year-old Brick Township, New Jersey, man will be facing up to five years in New Jersey State Probation when he is sentenced in March after pleading guilty on Wednesday to possessing a video file depicting the sexual exploitation and abuse of a child.

     According to Ocean County Prosecutor Bradley D. Billhimer, on Wednesday, January 28, 2026, Marc Fay, 42, of Brick Township, New Jersey, appeared in Ocean County Superior Court and pleaded guilty before Superior Court Judge Linda Baxter to one count of Possession of Child Pornography. In return for the guilty plea, the Ocean County Prosecutor’s Office will recommend that Fay be sentenced to five years of State Probation.

     Following entering his guilty plea, Judge Baxter accepted the plea and scheduled sentencing for March 27, 2026. At that time, in addition to the term of probation, Fay will be barred from any unsupervised contact with children and will have no internet contact.

     The guilty plea stems from an investigation launched by Detectives from the Ocean County Prosecutor’s Office High Tech Crime Squad and the Brick Township Police Department into Fay’s internet activities. During a forensic examination of Fay’s cellular phone, Investigators uncovered a video file depicting child pornography. 

     According to the Prosecutor’s Office, Fay was charged and surrendered himself to Detectives on October 16, 2025, at the Brick Township Police Department. Fay was processed on the charge and lodged in the Ocean County Jail. Following a detention hearing, Fay was released on monitoring conditions.
